Terms And Conditions Of Use, Privacy, Copyright, Disclaimer And Indemnity

The terms and conditions, disclaimer, privacy policy and indemnity set out below (“the Agreement“), govern your (“the User“) use of the websites (“the Websites“), whether wholly or in part, situated at the domains www.legalagreements.co.za and www.sitllegal.co.za.

Any use of either or both of the Websites by the User means that the User agrees to be bound by the Agreement, which will be deemed to have come into operation between the User and SITL Legal, a division of SITL Holdings (Pty) Ltd (“SITL“). For the avoidance of any doubt, SITL is the owner of the above websites.

In terms of the Agreement, you hereby absolve of all liability and indemnify SITL Legal (“the Owner“) and each of its directors, shareholders, employees, advisors, sub-contractors, marketers and personnel (collectively “the Further Entities“),from and against all actions, claims, demands, proceedings, investigations, liabilities or judgements (collectively “claims“) and any and all losses, damages, costs, charges and expenses and including all costs, expenses and fees incurred or sustained by the above parties, which arise from or are connected with investigating, preparing or defending any such claim, of whatever nature and in whatever jurisdiction, and which relate to or arise, directly or indirectly, from the User’s use of either or both of the Websites.

Regarding the sale of online agreements and e-learning, while every effort is made to procure that the User uses the correct agreement or e-learning or other online product on the Websites (“the Online Services“) for the User’s particular application, neither the Owner nor the Further Entities can be held responsible for any damages that the User may sustain, whether wholly or in part, as a result of the purchase of an Online Service, or Online Services, as the case may be, from the Websites, or the use of information hereon. The User agrees that the latter is reasonable, primarily as the law is dynamic and subject to developments all the time; further, the Owners and the Further Entities are not privy to the specific circumstances of each User of information on the Websites; such is not within their knowledge; nor can they be absolutely certain of the circumstances within which information on this Websites, or Online Services purchased from this Websites, is to be used. The User’s use of information on the Websites and the purchase of Online Services from the Websites is entirely at the User’s risk. It is the User’s responsibility, and the User is encouraged to seek bespoke legal advice available at info@sitllegal.co.za, or to employ the efforts of the User’s own independent legal advisor, prior to the User relying on the information and Online Services available on the Websites.

Every effort is made to ensure that the User has error-free and uninterrupted use of the Websites; however the Owner cannot guarantee such.

The intellectual property (which includes, but is not limited to, the agreements hereon, the e-learning, webinars, the explanatory notes, the logos, software and such like) in the Websites belongs to the Owner. The User is expressly prohibited from on-selling, re-selling, publishing, distributing or circulating any of the intellectual property.

Further to the above, the User agrees that the User will not allow any other person or entity unlawful access to any e-learning or Services that the User purchases from any or both of the Websites.

Information and Services available on the Websites are for use in, and subject to the law of, the Republic of South Africa. Use of the Websites is also subject to the laws of the Republic of South Africa, irrespective of where the User accesses such from. The User’s use hereof means that the User consents to the application of the latter-mentioned laws and to the jurisdiction of all South African courts.

The Owner will use all reasonable efforts to protect the User’s personal information and will not disseminate such to third-parties whether for commercial gain or otherwise.

The User is prohibited from using the Websites in a way that could adversely impact any or both of the Websites or the Owner. This means inter alia that the User may not gain unauthorized access to any of the Services. Should the User act in a manner that adversely impacts either or both or the Websites or the Owner or any of the Further Entities, the User will be denied access to the Websites and the above indemnity will be exercised against the User.

Once the User purchases an Online Service from either or both of the Websites, the User will receive the products purchased (whether such is an agreement or e-learning) via a secure internet download, together with a tax invoice.

Should there be a failure of the Online Service on the Websites and should the User not obtain the Online Service purchased, for any reason whatsoever, then the User shall afford the Owner a period of 30 (thirty) days from the date of the User notifying the Owner of such failure, to rectify such, failing which the Owner shall refund any monies paid by the User.

The Owner remains dedicated to protecting the User’s privacy. See the privacy policy on this website for more information. Any personal information that the Owner gathers on this site is used to identify Users of Services and Users of information solely. The Owner will use the User’s information purely for those reasons.

To the extent that a newsletter is created and the User subscribes thereto, the User’s information will be used solely to e-mail such newsletters to the User.

The Owner will never sell or disseminate the User’s information (whether wholly or in part) without the User’s express permission in this regard.

Please note that, even if the User does not purchase Online Services, the Websites may collect information relating to each visit, such as, name of internet service provider, IP address, pages accessed on this site, when Users accessed the Websites and the duration of each such visit to the Websites. The Owner assures the User that this information is to assist with administration of the Websites, to help improve content on the Websites and to ensure a more enjoyable, informative experience for Users of the Websites.

Payfast, which is the payment gateway used on the Websites, will process all payments made on the Websites. The Owner keeps no details of your credit cards. Please visit www.payfast.co.za for further information on its treatment of your information.

The Owner stresses that there is no intermingling of the information that the Owner keeps of Users and that that is entered on the Payfast site when the User makes purchases from the Websites.
